1. GENERAL INFORMATION

This Privacy and Data Protection Policy ("Policy") aims to demonstrate the commitment of BP TAX GLOBAL ADVISORY DO BRASIL - CONSULTORIA TRIBUTÁRIA INTERNACIONAL LTDA, registered with CPNJ under no. 28.403.904/0001-87 ("BP TAX" or "Company"), with the security and privacy of the information of our customers, employees, business partners, visitors to our website and other personal data subjects that we process in our activities and on our website

 

The Policy clarifies the general conditions of collection, use, storage and other forms of processing and protection of personal data by BP TAX, in accordance with Brazilian legislation on privacy and protection of personal data in Brazil (including the "General Law for the Protection of Personal Data" or "LGPD", the Civil Landmark of the Internet, the Consumer Protection Code, its regulations and subsequent amendments, as well as the guidelines of the National Authority).

 

With regard to the activities described in this Policy, BP TAX is considered as the Controller, and we are responsible for decisions regarding the processing of personal data.

PERSONAL DATA: information relating to a natural person identified or identifiable.

 

HOLDER: natural person to whom the personal data that are processed refer.

 

PROCESSING: all operations carried out with personal data, such as those related to the collection, production, reception, classification, use, access, reproduction, transmission, distribution, processing, archiving, storage, deletion, evaluation or control of information, modification, communication, transfer, dissemination or extraction.

BP TAX is formed by professionals specialized in the provision of global services, especially in the areas of international tax planning and fiduciary services, with emphasis on customers in the Latin American market.
 

Our mission is to serve this market with excellence, designing, suggesting and implementing structures for greater tax efficiency and succession planning in the main jurisdictions of the world.

 

BP TAX's main services are:

 

  • Tax planning and international succession;

  • Assistance to global and multinational families;

  • Constitution of investment funds for individuals and institutional investors;

  • Establishment of trusts and foundations of private interest;

  • Constitution and administration of companies in the main jurisdictions of the world;

  • Preparation of financial statements in international standards;

  • Assistance in filling out statements required by local authorities; and

  • Preparation of calculations for payment of taxes.

4. WHAT PERSONAL DATA BP COLLECTS?

 

In order to provide our services or assist visitors to our website, we may need to have access to, use, simply store, share with authorities, or process, in various ways, personal data provided by the owner himself, through BP TAX website contact channel, by email or in other interactions between our professionals and the holders, in person or remotely.

We do not anonymously collect any personal information or data regarding your browsing of our site.

 

 

5. HOW IS PERSONAL DATA USED?

 

BP TAX carries out the processing of personal data mainly for the following purposes and legal bases provided for in the LGPD:

 

  • Compliance with legal or regulatory obligations applicable to our activities in Brazil or other countries where we operate;

  • Execution of the contract or preliminary procedures, for the provision of our services to holders;

  •  Attendance to legitimate interests of BP TAX, such as the promotion of our activities or fraud prevention, always taking into account the protection of the fundamental rights and freedoms of holders; and

  • Attendance to requests from visitors made in the form contained in the website, with consent.

 

 

6. WITH WHON DOES BP TAX SHARE THE COLLECTED DATA?

 

We only share your data with third parties when necessary for the purposes described in this Policy, i.e. for the provision of our services, due to legal or regulatory obligation, or, at your request, for other purposes.   • Public agencies such as BCB (Banco Central do Brasil), Internal Revenue Service, National Financial Intelligence Units (COAF) and foreign, depending on the location of the provision of services.

 

7. HOW DOES BP TAX PROTECT THE COLLECTED DATA?

 

BP TAX, including all its employees, regardless of the hierarchical level, is fully committed to the confidentiality and security of your personal data. We take security, technical and administrative measures to protect your data from unauthorized access or any other form of inappropriate or unlawful treatment, and we carefully select and monitor our partners to comply with high security standards for data protection, in addition to the proper protection of their operating environment.

8. BP TAX TRANSFERS DATA INTERNATIONALLY?

 

Due to the contracting of certain types of services by our clients, it may be necessary to transfer and/or share personal data with our offices, business partners and government agencies in other countries, also considering the legal obligations related to the contracted services. In such cases, BP TAX takes all appropriate measures to provide the same level of protection given to your data in Brazil.

d) anonymization, blocking or elimination of your data that is unnecessary, excessive, or processed in non-compliance with the provisions of applicable law;

e) portability of your data to another service provider or product, in accordance with ANPD regulations, in compliance with trade and industrial secrets;

f) elimination of your data, except in the cases provided for in applicable law;

g) information of the public and private entities with which we share your data;

h) information on the possibility of not providing consent and on the consequences of its denial;

i) revocation of the consent previously granted, protected from the public interest that may justify the continuity of the processing or the existence of another legal basis authorizing it; and

j) opposition to any processing of personal data on the basis of one of the cases in which consent is waived, provided that non-compliance with the provisions of the applicable legislation has occurred and the public interest that may justify the continuity of the processing has been protected.
